Secondly, on the issue of people becoming overweight from Mcdonalds, comparisons can be drawn with US tobacco litigation such as the Engle case in florida which resulted in $145bn punitive damages on the basis that Phillip Morris produced a dangerous and defective product. Although this award was overturned on appeal it does show that the courts are open to such a challenge and I can see no logical reason why the fast food industry should not be open to a similar challenge.
Yes I am well aware that people make their own choices and should have the right to choose but this does not negate the fact that any company selling a consumer product which will potentially kill its customers should be open to litigation. You cannot base the legality of a product upon the personal autonomy of its potential customers.
